Acceptance of Terms

By accessing or using this service, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

Description of Service

We provide a software-as-a-service platform for AI image and video generation. We may modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use or security breach.

Acceptable Use

You agree not to:

• Violate any applicable laws or regulations.
• Infringe on the intellectual property or other rights of any party.
• Attempt to gain unauthorized access to our systems or data.
• Interfere with or disrupt the integrity or performance of the service.
• Use the service to send spam, malware, or other harmful content.

Prohibited Content

You may NOT use the service to generate, upload, distribute, or attempt to generate any of the following:

• Non-consensual intimate imagery (NCII) of any individual;
• Deepfake or synthetic media depicting real, identifiable persons in a misleading or defamatory context;
• Sexually explicit content depicting real persons (including likenesses) or any minors;
• Content depicting any person who is or appears to be under 18 in a sexualized, exploitative, or otherwise harmful context;
• Child sexual abuse material (CSAM) of any kind — confirmed cases will be reported to relevant law-enforcement authorities;
• Content that infringes third-party intellectual-property rights (trademarks, copyrights, publicity rights);
• Content that defames, harasses, threatens, or incites violence against any individual or group;
• Content promoting illegal activities, terrorism, hate speech, or self-harm;
• Misleading content designed to impersonate any real person, organization, or government entity.

Consent representation for uploaded images. By uploading any photo containing identifiable persons, you represent and warrant that one of the following is true: (a) you are the subject depicted; (b) you are the lawful owner of the image; or (c) you have obtained explicit written consent from every identifiable person to use their likeness in AI-generated transformations. You bear full legal responsibility for the lawful provenance and consent of any uploaded content.

Content Moderation & Enforcement

To maintain a healthy content environment and meet our compliance obligations, we apply layered moderation to generation requests:

1. Platform pre-moderation. Before generation, prompts pass a two-tier check (local high-risk rules + AI classification) that blocks clearly prohibited requests.
2. Provider safety baselines. All upstream AI providers enforce non-configurable safety baselines (including CSAM, terrorism, etc.) that apply to every request independently of our configuration.
3. Contractual layer & reporting. These Terms expressly prohibit the content above, which you acknowledge before use. Suspected violations may be reported to support@genvizu.com.
4. Enforcement. Confirmed violations result in content removal, account suspension, credit forfeiture, and reporting to authorities where required. When moderation or a provider filter blocks a request, no content is generated and no credits are consumed.

Subscriptions & Billing

• Subscription model. Paid subscriptions are billed in advance for the selected subscription period. Each plan unlocks its listed features and grants a recurring allowance of credits.
• One-time credit packs. In addition to subscriptions, we offer optional one-time credit packs. A pack is a single charge with no auto-renewal. When the purchase page states that PAYG creation access is currently available, a valid paid pack order unlocks the listed PAYG public core capabilities while it remains unrefunded, undisputed, and within its approximately 365-day access period. A pack does not create a subscription, grant subscription-only benefits, or bypass any model or Skill minimum-plan requirement. Generation still requires enough credits for the requested task.
• Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price, using your payment method on file, until you cancel.
• Cancel anytime. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then. We do not provide prorated refunds for the unused portion of a period.
• Price changes. We may change subscription prices or plan contents. We will give you reasonable advance notice of any price increase, which takes effect on a subsequent renewal; you may cancel before it applies.
• Billing information. You are responsible for providing accurate, current billing information and for any taxes that apply.
• Refunds. Refunds are governed by our Refund Policy. The current period and renewals are generally non-refundable; consumed credits are never refundable.

Credits

• Credits are an account-bound service right, not property. Credits grant a limited, account-bound, non-transferable right to use the service to generate content. This does not limit permitted use of generated content under the Generated Content section. Credits are not money, not a stored-value instrument, and not your property.
• No cash value. Credits have no cash value, cannot be redeemed, sold, transferred, or exchanged for cash, and are not a deposit or claim against us.
• Independent expiration; no extension on renewal. Each subscription-credit grant expires on its stated expiration date (typically approximately 32 days after a monthly grant). Renewal does not extend an older grant. One-time credit-pack credits expire approximately 365 days after purchase. Promotional and bonus credits may expire or be revoked. Unused or expired credits are forfeited.
• Consumption. Credits are consumed as you generate. Failed generations are auto-refunded and provider content-filtered generations do not consume credits, as described in the Refund Policy.

Referral Codes & Promotional Credits

• Referral rewards are promotional credits. Credits earned through a referral or creator code — both the bonus credited to the invited buyer and the reward credited to the code's creator — are promotional credits under this section. They have no cash value, cannot be redeemed for cash, sold, or transferred, and expire on their stated expiration date.
• Rewards follow the underlying payment. A referral reward is granted only on the invited user's first paid order. If that order is refunded, charged back, or reversed for any reason, we may revoke the unused portion of both the buyer's bonus and the creator's reward.
• Self-referral and multi-account abuse is fraud. Redeeming your own code, creating additional accounts (directly or through others) to trigger referral rewards, or otherwise gaming the referral program is a material breach of these Terms. We may revoke any credits obtained this way — including credits already spent, by adjusting your balance — withhold future rewards, disable the code, and suspend or terminate the accounts involved.
• We may change or end the program at any time. Reward percentages, caps, per-code limits, and program availability may be changed or discontinued at any time without notice. Credits already granted and not revoked keep their stated expiration.

Intellectual Property

The service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Generated Content

• No platform ownership claim. As between you and Genvizu, we do not claim ownership of content you generate using the service. Subject to applicable law, the access rights that applied when the content was generated, and the terms of the upstream model provider, you may use generated content for personal or commercial purposes. Later cancellation or expiry does not by itself revoke a use that was permitted when the content was generated; refunds, chargebacks, unlawful activity, and provider-specific restrictions may still affect those rights.
• No copyright or exclusivity guarantee. Generated content is provided as is. We do not guarantee that it is eligible for copyright registration, protectable, exclusive, or different from content independently generated for another user. We also do not guarantee that it is free from third-party intellectual-property, privacy, publicity, or other rights.
• Your inputs and intended use. You are responsible for ensuring that prompts, reference media, trademarks, copyrighted material, likenesses, and other inputs are lawfully provided, and that your publication or commercial use of generated content complies with applicable law and clears any required third-party rights.
• Provider terms apply. Upstream model-provider terms and restrictions apply to use of their outputs. Some third-party models have narrower commercial-use terms; review the disclosure shown in the model selector before using their output. For models marked as commercially restricted, including Midjourney where shown, we recommend personal use unless you independently confirm the necessary rights.
• No infringement indemnification. We do not provide legal clearance, a warranty of non-infringement, or any defense, indemnity, or reimbursement for claims relating to generated content, to the maximum extent permitted by law.
• Technical identifiers. Some providers may embed watermarks, provenance signals, or other technical identifiers in generated output. We do not promise to remove or disable them.
• Mandatory law controls. Nothing in this section limits rights or obligations that cannot lawfully be excluded, including mandatory consumer-protection and copyright rules.

API Data Terms

These terms apply when you access the service through our read-only API with an API key.

• Search and reference only. Prompts, metadata, and media links returned by the API are provided so you can search, reference, and link to the content. They are not provided for bulk redistribution or for building a competing prompt database.
• No training rights. API access does not grant any right to use the returned content to train, fine-tune, or evaluate machine-learning models.
• Keep attribution. When you display or reuse a prompt, keep the attribution returned with it: the original author, the source link where available, and a link back to the Genvizu page.
• Same visibility rules. The API follows the same content visibility, masking, and moderation rules as the website. Keys cannot be used to bypass them.
• Quotas and enforcement. Each account has a daily request quota based on its plan. We may change quotas, throttle requests, and suspend or revoke API keys or accounts that exceed them, scrape, share keys, or otherwise abuse the API.
• Key security. You are responsible for keeping your API keys secret and for all activity performed with them. Delete a key immediately if you believe it has been exposed.

Termination

We may suspend or terminate your access to the service at any time if you violate these terms, including for abuse, fraud, or unresolved payment disputes. On termination, remaining credits may be forfeited. You may close your account at any time through your account settings.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the service.

Changes to These Terms

We may modify these Terms at any time. We will notify users of any material changes by updating the date at the top of this page and, where appropriate, sending a notice through the service.
